Property contract signed, what is needed prior to completion in the Notary?

When purchasing a Spanish property, a lot of purchasers do not want to enlist the services of an expensive lawyer, which some in this area charge between €1500.00 to €1800.00. The owners may give you a copy of the old property deed of when they bought the property, but this deed was only valid they day the property was purchased, and now the property may have a mortgage applied to it or other charges, that it will not say in that deed.

Should you decide not to use the services of a lawyer, and do all the legal work yourself, you will save money, but if you are not fluent in Spanish, or do not know about legal property matters, we recommend using a professional, who has a lot of experience.

Phil can offer you this service which will include:

1. Check with the townhall that there are no outstanding taxes for the council tax, rubbish tax and recycling tax.
2. If the property is an apartment or a property that has a community of neighbours, he will request a certificate from the administrator stating that all community fees are paid completly upto the time when you are going to complete the sale in the Notary, and also that there has not been any work agreed in a community meeting, budgets made for payment of the work, and date when the work will commence, by Spanish law, if this has been passed, its the owners responsibility to pay for the work, and not you, the purchaser.
3. At this stage Phil will request a new Nota Simple, just to double check that since the contract, the owner has not had any debts, charges, mortgages put on the property.
4. Now a date and time is fixed for completion in the Notary, Phil will visit the administration side of the Notary, make an appointment, supply a copy of the contract so that they can start drafting the new buy and sell deed, and to also order a special type of Nota Simple, which is in Spanish called a Continuada, this is a Nota Simple, but in more depth, and also from the time orders the continuada, locks the land registry for registering any debts etc on the property.
