You have decided to buy a Spanish property, but need a Buy and Sell contract.

Depending where the Spanish property that has originated from, regarding contracts, the contracts may vary between the following:

1. A property that has originated from a bank source or group of investors, in this case the company who is responsible for the property will generate the contract themselves, will be a buy and sell contract, which you will have to pay the deposit and sign the contract, and then complete within 1 month. The amount of the deposit will be decided by which bank owns it or what group of investors. Please note, in general, buying one of these types of properties, the contract will be supplied, only in Spanish.

2. A private seller property that you are purchasing through our company Buy Spain Properties, Phil the company owner, will generate the reserve contract, and the buy and sell contract, and both contracts will be in both languages, English and Spanish. The first is to take the property off the market, called a reserve contract, and the second one later, which will be the buy and sell contract, giving you time to do the legal checks, prior to paying the rest of the deposit.

3. A property that you are buying through another estate agents and not Buy Spain Properties, in general, the estate agents will use their lawyer or actually generate 2 contracts themselves, again, the first is to take the property off the market, called a reserve contract, and the second one later, which will be the buy and sell contract, giving you time to do the legal checks prior to paying the rest of the deposit. Please note, in general, buying through another estate agent, there is a strong possibility that both contracts will be supplied, only in Spanish.

4. A private seller that you are buying the property directly from him with no estate agents or lawyers involved. In the case, Phil can generate both the reserve and buy and sell contract for you, each contract will be in both languages, English and Spanish. As you are not purchasing the property through Buy Spain Properties, there is a cost for the generating of both contracts, which is €120.00

The full deposit amount is normally 10% of the value you are buying for, and the reserve deposit which is discounted from the full deposit, will be a figure, which both you and the owners are in agreement with, so for example, the price of the property is 150.000 euros, and you pay 3.000 euros to reserve it, when signing the buy and sell contract, you will pay 12.000 euros.
