Legalize the square meters of your property.

Have you previously bought a property via another estate agent or privatley owned, only to find out that the true square meters of the property are not fully registered? This maybe because the property has been extended over the years, and then the changes have not made, in the tax office records and also in the land registry. If you are fluent in Spanish and have the time to carry out the work, it is possible to do it yourself, but if you are not fluent, and unsure, then we can carry out the process for you.

If you are planning to sell your property, and there is a large difference in the m2 of your property, and whats actually registered in the land registry, this could be a big problem, for the following reasons.
1. The buyers want the changes made before they buy the property, so if they sell in the future, they will not have the same problem.
2. The buyers are buying with a Spanish mortgage, the valuer who will go to the property, measure, and then see what is registered, he can legally only value the m2 which are registered, and the bank will only loan a certain percentage of that value. So if your property for example is 80m2, and in the land registry states only 60m2, the valuer, will only be able to value the property at 60m2.

Can all properties have legalized the build size, the answer is no, if its a villa for example, that has a rustic status, and is situated on a plot of land smaller than 10.000m2 or in some cases 23.000m2, then it will not be possible.

In general, only townhouses and urban villas, detached and semi detached, come under this category.

You will need the services of a technical architect, to measure, and draw floor plans with sizes, then a architect to sign off the floor plans and report, and register the floor plans and the report with the college of architects of Valencia (for the area in which we offer this service).

Arrange an appointment in a Notary who specializes in this type of deed, you will need the old deeds and the Nota Simple (simple note) from the land registry.
In the Notary, you will sign a deed of new works (obra nueva), where it will stipulate what has been added to your property, with the new m2, including the documentation of the architect, and the college of architects of Valencia, of which this documentation will be incorporated into the deed.
The council tax office are automatically notified of the change, and will update their records accordingly.

After the signing of the new deed, the Notary official in the payment office, will generate a document, which will include:
Notary fees.
Taxes for the declaring of the new m2 to the tax office.
Registry fees.
And fees to do all of the registration process for you.
From the time the Notary pays the taxes etc, and sends the documents to the land registry, it can take upto 8 weeks to receive back the rectified documents.
