Phil offers the following when you choose to sell your property with his company Buy Spain Properties.
. Visits your property to speak with you regarding the selling process.
. Checks the legal documentation to see if their are any irregularities with the property, square meters etc. (Do not worry if there is, as Phil also specializes in correcting documentation.)
. Takes high resolution photos for publishing, as well as a professional video to later be published in his website, along with property portals, and YouTube.
. Measures and draws floor plans with room sizes.
. Publishes the property on the internet. A private link will be sent to you first for your approval of the advert.
. Phil will visit the property with the clients, if they are foreign, he will translate for you both.
. Once a buyer is found, firstly Phil will order from the member of registries of Spain, of which he is a member, a new land registry document.
. You are selling the property, you will not need a lawyer!
. Phil will generate a buy and sell contract in both languages, Spanish and English, and send to you and the buyer by email, and then if needed make any changes, before signing.
. Once the contract is ready, both you and the buyer, can come to the office we have in Gandia, sign the contract, and the buyer will make an immediate transfer for the deposit to your account.
If the property has a current and valid CEE energy certificate, then there will be no need for the architect to come to your property to measure and generate the certificate, but if not, Phil can organize the architect to go there, and within normally 48 hours he receives the certificate by email.
If your property has a mortgage attached to it, once you and the buyer have decided a completion date in the Notary, Phil will accompany you to your bank, speak with the bank manager, tell the date of completion, and the bank manager will give you a document stating your names, account, the amount of the mortgage to be cancelled, and the cancelling date, which will be the completion date. This document will be passed to the buyers bank, so they know the amount to pay for the cancellation.
The same day as going to the bank, Phil will also accompany you to the council tax office, and get a certificate that you are debt free of council, rubbish and recycling taxes, if when we visit the council tax office, there is outstanding bills which are not paid, Phil will ask for a payment letter, which you can go and pay online or via your bank.
At the same time, we will have an appointment with another official in the Plus Valia department to see if any, if there is any taxes to pay, I have outlined this later down the information.
If there are bills which are outstanding to be paid, once paid, another appointment in the council tax office will be made to get the clear of debt document from them, as the Notary will request to see this document.
If you are a Spanish tax resident, you will have to contact your accountant, to get a document accrediting this, otherwise the Notary will have no choice than to put you as a non tax resident, and you will have a 3% retention of the purchase price, that the buyer will not pay you but to the tax office. If you non a Spanish tax resident, you will see in the section below, retention and modelo 211.
One other document that we will need for completion, but only applies to a property subject to having a community, is a certificate from the community administrator, stating that on the date of completion you are debt free.
If it has been agreed before hand that the buyers pay the Notary fees, they have the right to choose which Notary will be used, if it was agreed that the Notary fees would be paid half and half, then it will be down to you both to choose a Notary together, Phil will visit the Notary with all the documentation, and prepare with the official the deeds, which on the completion day will be signed in front of the Notary.
On completion day, you will meet Phil in the Notary 15 minutes before the appointment, so the official can check your passport and NIE or TIE numbers, and print a copy of the deeds, so Phil can translate for you.
In front of the Notary, you will be read the deed by the Notary, with him stopping now and again to explain certain points, as the Notary is speaking, Phil will also be translating what he is saying.
After the completion. There are still a few things to do..
So still in the Notary, if you agreed to pay half the fees of the Notary, first we go to the payment office, pay the bill by cash, credit or debit card, but obviously if its was agreed the buyer pays all, this this part will be skipped.
Next is to go to the printing office, and get 2 copies the deeds signed, these are called copia simplies (simple copies), of which one will be for you to keep, and one that we will need back in the tax office of the townhall.
If you are not Spanish tax residents, Phil will then generate the retention document called the modelo 211, and send you a copy, and the buyer, the buyer will then print, go to his bank, pay to the tax office the 3% that was retained, and then present to the Notary and the liquidation office of the land registry.
Phil will then make a previous appointment in the relevant council tax office to see is you are liable for Plus Valia tax, which is the increase in urban land value, between when you bought and sold, you will need a copy of the deeds of when you purchased the property, and the copy of the new deeds of when we signed the deeds in the Notary a few days before.
If the tax office is Gandia, she will work out the bill, give you a copy to pay, and you have the option to pay there and then or pay in your bank, if paid in your bank, there is no need to go back to the tax office, as your payment will automatically be sent to the townhalls tax system.
But if your property comes under a different tax office, we will have to go to that tax office, the same as you would have done in Gandia for the Plus Valia, present the documentation as before, but you may not get the bill for a long time, and could be upto a year.
Some buyers request that the seller may go back to their country, not to pay this tax, and this tax is then passed to them, as a debt to be paid by them, so they may request that when we previously went to find out the approximate value you would pay if any, that they are supplied with this information, they retain the money from the sale, and when the debt is passed to them, they pay it.
If you are a non Spanish resident for taxes, that’s it, we are finished.
But if you are a Spanish tax resident, remember to declare the sale and the profit you have made on your tax declaration at the end of the year, failing to do so, will lead to a massive fine.
